FagrellWorks, LLC, an Ohio limited liability company doing business as SquawkFree (the “Company”, “SquawkFree”, “us”, or “we”), respects your privacy and is committed to protecting it through our compliance with this policy. As explained below, we collect information from users (“you”, “your”, or “user”) in various ways when you interact with our website at https://squawkfree.com (the “website”) and the services offered through it (the “Services”). The information we collect can include information that can be used to personally identify you.

Please read this Privacy Notice carefully. By using the website, you consent to our collection and use of information as explained in this Privacy Notice and agree to be bound by the other terms and policies posted on the website. If we post a modified version of this Privacy Notice to the website, your continued use of the website means that you consent to the terms of the modified notice. By agreeing to this Privacy Notice, you also agree to our Terms of Use, incorporated herein by reference.

2. Collection of Information

The Company collects information from you when you sign up for an account, send us an email, make a purchase through the website, or enter information into the Services. This information may enable us to identify you personally, such as your: email address, name, phone number, physical address, Internet protocol (“IP”) address (which may also be contained in server logs), pilot certificate and currency information, and any other information you provide or upload to the website — including aircraft information, flight logs, maintenance and inspection records, Airworthiness Directive compliance records, squawks, scheduling and dispatch records, photographs and documents, and responses filled in on forms made available on the website (collectively, “Personally Identifiable Information”). We may also collect and store information locally on your computer or device using mechanisms such as browser web storage or application data caches.

Payments are processed by our third-party payment processor (Stripe). We do not store your full payment card number on our systems; our payment processor's collection and use of your payment information is governed by its own privacy policy.

The Company also collects non-personally identifiable information regarding your usage of the website. Non-Personally Identifiable Information may include: website pages viewed, sites visited before visiting the website, frequency of visits, clickstream data, browser type, operating system, internet connection speed, time spent viewing pages or using features, demographic data such as server locations, cookies existing on your computer, search criteria used and results, date and time of access, and other information that does not specifically identify you. We may also have access to your Personally Identifiable Information if you log into the website through a third-party identity provider (such as Google).

In addition, the Services may obtain information about aircraft you register from third-party and government sources — for example, FAA registry data, FAA Airworthiness Directive databases, aviation weather products, and publicly broadcast ADS-B flight data — and associate that information with your account and aircraft.

We may collect the above information using various technologies, including, but not limited to: cookies, web beacons, web session variables, server log files, browser plug-ins or add-ons, or JavaScript. “Server log files” are log files automatically created and maintained by a server of activity performed by the server, which can include information about any transaction you conduct with the server. “Web beacons” are typically transparent graphic images placed on a site or in an email which allow the website to record simple actions of the user.

Our use of “cookies.” Cookies are pieces of information, usually in the form of a small text file, that may be placed on your computer by a website for the purpose of facilitating and enhancing your interaction with that website. We use cookies to recognize you when you log in to the website and to provide functionality such as keeping you signed in. We may at times use analytics programs and service providers which use first-party cookies to report on your interactions with the website. The Company may make certain of your information visible to other users of the website according to the sharing, membership, and organization permissions you and other users configure — for example, aircraft you share with co-owners, members of an organization, or instructors.

The Company may also use and disclose user information: to investigate and help prevent potentially unlawful activity or activities that threaten the integrity of the website or network; to protect and defend the Company's rights or property or the rights or property of others; as required by courts or administrative agencies; and in connection with a financing, sale, merger, or reorganization of the Company's business or assets. Any successor in interest to our business would acquire the information we maintain and may alter the terms of this Privacy Notice without prior notice or liability.

4. Our Rights to Use, Sell, and Resell Data

By entering information into the Services, you grant the Company a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable right and license to use, reproduce, modify, adapt, aggregate, de-identify, distribute, license, sell, and resell the data and content you enter into or upload to the Services — including, without limitation, aircraft, flight, maintenance, inspection, scheduling, and operational data — for any lawful business purpose, including the creation and commercialization of data products, analytics, market insights, and benchmarks.

Where we sell or share data in a form that identifies you personally, we will do so in accordance with applicable law, including honoring any opt-out rights described in Section 6 (Opt-Out Policy) and Section 13 (Your California Privacy Rights). Data that has been aggregated or de-identified so that it does not reasonably identify you is not Personally Identifiable Information and may be used, sold, and resold without restriction.

5. Third-Party Websites and Services

The website may contain links to other websites and services not maintained by the Company, and may embed or rely on content and data provided by third parties (for example, payment processing, mapping, weather, and flight-tracking services). This Privacy Notice is not applicable to and does not govern any such third-party websites or services. We encourage you to read the privacy notices of each website and service that you visit or use. We do not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other websites or services.

6. Opt-Out Policy

We may at times send you email communications with marketing or promotional materials. If you prefer not to receive such marketing or promotional emails from us, you may unsubscribe by following the instructions in the email or by emailing us at support@squawkfree.com.

If you wish to opt out of the Company selling or otherwise disposing of your Personally Identifiable Information to third parties for such third parties' own business or direct marketing purposes, you may email us at support@squawkfree.com. Please note that we cannot delete or retrieve your Personally Identifiable Information from third parties after it has been provided to them; if you wish to have such third parties delete your information, you must contact them directly. Opt-outs do not apply to aggregated or de-identified data.

Opt-out requests may take up to one week to process. At times we may need to send you communications that are transactional in nature — such as service or termination announcements or payment confirmations — which you will not be able to opt out of.

You may modify the information concerning your account by logging in and editing your profile and settings. You may also request a full export of your data from the Settings page at any time.

7. Children's Privacy

The website is not intended for use by children, especially those under eighteen (18) years of age. No one under eighteen (18) years of age is allowed to use the website, provide any personal information, or receive our email distributions. We do not knowingly solicit or collect Personally Identifiable Information from children under the age of thirteen (13) or anyone under eighteen (18) years of age. If you believe that a minor has disclosed Personally Identifiable Information to the Company, please report this to us immediately at support@squawkfree.com.

The Company reserves the right, in our sole discretion, to change, modify, add, or remove portions of this Privacy Notice at any time. Any changes or updates will be effective immediately upon posting to the website. You should review this Privacy Notice regularly for changes, and can determine if changes have been made by checking the “Last updated” date above. Your continued use of the website following the posting of any changes to this Privacy Notice means you accept those changes.

You are solely responsible for ensuring that your collection, entry, storage, and sharing of information through the Services — including information about other individuals, such as students, members, instructors, or co-owners — complies with all laws, regulations, and contractual obligations applicable to you. This Privacy Notice may not constitute your entire set of privacy rights, as these vary from state to state. Certain regulations issued by state or federal government agencies may require us to maintain and report demographic information on the collective activities of our users, or to retain personal information for recordkeeping, reporting, and audit purposes.

Our servers are located in the United States of America. We therefore process and store your Personally Identifiable Information in the United States of America. If you are not located in the United States, please be advised that your Personally Identifiable Information may be transferred to, and used in, locations outside of your province, country, or other governmental jurisdiction where the privacy laws may be different than those in your jurisdiction. You hereby consent to such transfer and use in all respects.

12. Applicable Law and Jurisdiction

The website is maintained in the United States of America. This Privacy Notice shall be construed and governed by the laws of the State of Ohio, without giving effect to its conflicts of law principles. Each party hereby irrevocably submits to the exclusive jurisdiction of the state and federal courts located in the State of Ohio in connection with any litigation, dispute, claim, legal action, or other legal proceeding arising out of or relating to this Privacy Notice, and waives any claim that such party is not subject personally to the jurisdiction of such courts, that the proceeding is brought in an inconvenient forum, or that the venue of the proceeding is improper. EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY IRREVOCABLY WAIVES THE RIGHT TO A TRIAL BY JURY IN RESPECT TO ANY PROCEEDING BASED HEREON, OR ARISING OUT OF, UNDER, OR IN CONNECTION WITH, THIS AGREEMENT.

California law permits California residents to request certain details about how certain types of their information are shared with third parties for those third parties' own direct marketing purposes, and may provide rights to know what personal information we collect, to request deletion of personal information, and to opt out of the sale or sharing of personal information. We are not required to respond to requests made by means other than the provided email address.
